Terms & Conditions

General
In these conditions:
(a) “The Buyer” means the person, firm, or company who accepts a quotation from The Seller for sale of The Goods or whose order for The Goods is accepted by The Seller.
(b) “The Seller” means RE Enterprise Unipessoal LDA whose business address is RE Enterprise Unipessoal LDA, Avenida do Atlântico, Nº 16, escritório 5.07, 1990-019, Parque das Nações, Lisbon, Portugal. Telephone: +351 924968060. RE Enterprise Unipessoal LDA is registered in Portugal with company number 517554399 at registered office, Avenida do Atlântico, Nº 16, escritório 5.07, 1990-019, Parque das Nações, Lisbon, Portugal. 
(c) “The Goods” means the goods and or materials as set out on this website.
(d) The contract between The Seller and The Buyer shall be subject to these conditions, which shall govern the said contract to the exclusion of any other terms and conditions subject to which any quotation is accepted or purported to be accepted, or any order is made or purported to be made by The Buyer.
(e) The contract between the Seller and the Buyer does not affect the Buyer’s statutory rights.
(f) No variations of these conditions shall be binding unless agreed in writing by a director of The Seller.
(g) Any typographical, clerical, or other error or omission in any sales literature, quotation, list price, acceptance of offer, invoice, or other document or information issued by The Seller shall be subject to correction without any liability on the part of The Seller.
(h) The headings in these conditions are for convenience only and shall not affect their interpretation.
(i) If any provision of these conditions is held by a competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these conditions and the remainder of the provision in question shall not be affected thereby.


Terms of Payment
Payment can be made by bank transfer or major credit card.
You can order through our website.  If you pay by credit card, we will dispatch the goods as soon as your payment has been processed. 
Orders placed and paid for by 11 am will be dispatched by the next working day.
How Can I Pay for My Order?
We accept major credit cards and bank transfers. 
What Are the Shipping Charges?
Deliveries are by DPD and UPS for all international shipments (Ts&Cs apply). Shipping charges may vary depending on the country and location. Larger or heavier deliveries may require a signature to confirm receipt. 
The courier will hold parcels for a few days, and when they are not collected or delivered, they will be sent back to us.
If you would like us to resend your order, we will regrettably have to charge you. If you would like to cancel your order, we will refund you less than the shipping costs.
We are not liable for missing or lost parcels if an incorrect/incomplete delivery address has been provided.
Items ordered are dispatched Monday-Friday, excluding public holidays.
Orders outside of mainland Portugal are unlikely to arrive the next working day.
Some European and the rest of the world orders are charged per weight. Please select and confirm the exact shipping address when you reach the checkout, and we will calculate the shipping cost for your order. Alternatively, please contact sales@rougegarments.co.uk for a quote before placing your order.
European orders usually arrive within 3-5 working days
The rest of the world takes 7-10 working days.
Tracking your order: Your unique tracking number will be emailed to you when we dispatch your order.


Limits of Contract
Orders placed on the www.rougewholesale.eu website for goods are subject to acceptance and availability. 
No contract will exist between the Buyer and the Seller until your shipment has been dispatched.


Data Protection
The Seller is compliant with the Data Protection Act 2018. Your details will not be passed on to any third party without prior consent. We may use personal information to provide the services you have requested. We will only use this information for auditing, research, and analysis to operate and improve our technologies and services.


Privacy Policy
We only use your information to provide information you have requested through our newsletter. Your details are never shared or passed on to any third party. 
You can opt out of mailing by unsubscribing. 


Returns Policy
You may return any item to us for a full refund (or replacement) within 30 days if the product is unopened.
You should inspect the goods immediately upon receipt, and you must notify the Seller as soon as possible if the goods are faulty or incorrect. Items must be tested for their function and checked by hand before use intimately. Please make sure you have received the product you ordered and that it works correctly as soon as possible. If you fail to notify us of a fault or a problem with your order, you will be deemed to have accepted the goods and that they are in working condition.
If your order has already been dispatched when we receive your cancellation, we will deduct the cost of shipping from your refund. All returned items must not be opened or used and must be returned in their original packaging.
If the returned items are defective, you must send them back to us at your own expense, and we will only issue a refund if the items (including packaging and accessories) have not been damaged. We aim to refund you in 7-15 working days upon receipt of the returned goods.


Force Majeure
The Seller shall not be liable to the Buyer or deemed to be in breach of contract because of any delay in performing or failing to perform any of the Seller’s obligations about the goods if the delay or failure was due to any cause beyond the Seller’s control. Without prejudice to the generality of the foregoing, any act of God, war, strikes, flood, lockouts, fire, tempest and inability of The Seller to procure materials or articles required for the performance of the contract which may prevent the fulfilment thereof shall be regarded as causes beyond The Seller’s reasonable control. In the event of any failure or delay to perform any contract as a result of the said causes such contracts, at The Seller’s discretion, may be varied or cancelled by The Seller or delivery may be wholly or partly suspended and time for delivery may be extended by The Seller without The Seller being liable to The Buyer or being deemed to be in breach of contract.


Disclaimer
All orders of products on the website are subject to acceptance and availability. The Seller may choose to cancel your order.
All products sold through The Seller’s websites are sold as novelty items. The Seller cannot be held responsible for injury caused by misuse or mishandling.
Items on The Seller’s websites may differ slightly sometimes by color or their packaging. The Seller cannot be held responsible for errors or any interruptions on the site.


Cancellations
No order accepted by the Seller can be cancelled without the Seller’s consent in writing (or by e-mail correspondence).
